Q: The outdoor parking lot entrance/exit of our condo is located on a busy pedestrian street. There is a security gate that opens and closes to allow access to the parking lot, and includes a sensor (just as you would have with a garage door) that prevents the gate from closing if it detects an object in its path. Recently, I was exiting the parking lot but had to wait for pedestrians to pass so that I could safely enter the street. As I was waiting, the security gate started to close and struck my vehicle. The condo board contends that my vehicle is too low for the sensor on the security gate to detect. My contention is that the sensor is not installed at a height to detect all vehicles. Should the condo corporation be responsible for the repairs to my vehicle?
